1. Acceptance
By installing, accessing, or using AudioMark, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not install or use the application.
2. License
AudioMark is proprietary software.
The developer grants you a limited, non-exclusive, non-transferable, and revocable license to install and use the application on your personal devices.
The application may offer both free and pro features. Access to pro features requires an in-app purchase. The developer reserves the right to change which features are included in the free or pro tiers at any time.
This license does not grant any ownership rights to the software. All rights not expressly granted are reserved by the developer.
3. Restrictions
You agree not to:
- Copy, redistribute, publish, sublicense, sell, or make the application available to third parties without prior written permission from the developer
- Modify, adapt, or create derivative works of the software
- Reverse engineer, decompile, or attempt to extract the source code, except where permitted by applicable law
- Use the software in any unlawful manner
- Distribute, upload, or share the application through unauthorized channels
The developer reserves the right to pursue all available legal remedies to remove or block unauthorized copies.
4. Intended Use
AudioMark is intended as a tool for audio listening, evaluation, and marking. The software is provided for general-purpose use and no guarantee is made that it will meet specific user requirements.
5. Disclaimer of Warranty
AudioMark is provided "as is" and "as available", without warranty of any kind, express or implied.
This includes, but is not limited to, implied warranties of:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Reliability or availability of the software
Use of the software is entirely at your own risk.
6. Limitation of Liability
To the maximum extent permitted by law, the developer shall not be liable for any damages arising from the use or inability to use AudioMark.
This includes, but is not limited to:
- Loss of audio files or other data
- Device malfunction or damage
- Loss of profits or business interruption
- Indirect, incidental, special, consequential, or exemplary damages
This limitation applies regardless of the legal theory involved, including contract, tort, negligence, or otherwise.
In no event shall the total liability of the developer exceed the amount paid by the user for the application.
7. Purchases and Refunds
In-app purchases are processed by the platform provider (e.g., Google Play). Refund policies are governed by the respective platform's terms. The developer is not responsible for payment processing or platform-related billing issues.
8. User Responsibilities
By using AudioMark you agree that:
- You are responsible for maintaining backups of your audio files
- You have the legal right to use any audio files you import
- You are solely responsible for any recordings you make using the app, including obtaining any required consent from third parties
- You use the application at your own risk
AudioMark copies imported files into its private storage and does not modify the original source files.
9. Data and Privacy
AudioMark operates entirely offline. The application does not collect, transmit, or share personal data to external servers. All data — including audio files, markers, and settings — is stored locally on the user's device.

10. Third-Party Services
AudioMark does not use third-party analytics, advertising, or tracking services.
The application uses open-source libraries for core functionality (e.g., audio playback, network file sharing). These libraries operate locally and do not transmit data externally. See the Privacy Policy for a full list.
Certain optional features, such as local network file access (e.g., SMB file sharing), are initiated solely by the user and operate only within the user's local network.
11. Availability
The developer makes no guarantee that the application will remain available, updated, or maintained. The application may be modified, discontinued, or removed from distribution platforms at any time without notice.
12. Changes to These Terms
These Terms of Use may be updated from time to time. The most recent version will always be included with the application and indicated by the "Last updated" date at the top of this document.
13. Governing Law
To the extent permitted by applicable law, these terms shall be governed by the laws applicable to the developer's place of residence. Any disputes arising from the use of the software shall be subject to the jurisdiction of the competent courts at the developer's place of residence.
